1. About these Terms

These Terms of Service (the Terms) are a legally binding agreement between you and Book Funduq (Book Funduq, we, us or our), the operator of the website bookfunduq.com and its associated services (together, the Platform). By accessing the Platform, creating an account, or making a booking, you confirm that you have read, understood and agree to be bound by these Terms.

The following policies form an integral part of these Terms and are incorporated by reference: our Privacy Policy, Cookie Policy, Cancellation & Refund Policy and Payment Terms. Where a booking-specific condition displayed during checkout (for example a property's cancellation window) differs from a general statement in these Terms, the booking-specific condition prevails for that booking.

If you do not agree with these Terms, you must not use the Platform.

2. Definitions

• Platform — the website bookfunduq.com, together with all related pages, tools and services operated by Book Funduq.
• Property — the hotel or other accommodation provider listed on the Platform with which you enter into an accommodation contract.
• Booking — a reservation of one or more rooms at a Property made through the Platform.
• Total Price — the full price of your stay as shown at checkout, expressed in US dollars (USD).
• Booking Deposit — the portion of the Total Price that you pay online at checkout. The Booking Deposit corresponds to Book Funduq's service fee for facilitating the Booking and is deducted from the Total Price.
• Balance — the remainder of the Total Price (Total Price minus Booking Deposit), payable by you directly to the Property.
• Free-Cancellation Deadline — the date and time, shown before you complete a Booking, until which the Booking can be cancelled with a full refund of the Booking Deposit.
• Confirmation Code — the unique code issued for each Booking, used to identify, look up and manage the Booking.

3. Our role and the accommodation contract

Book Funduq is an online booking intermediary. We operate the Platform on which Properties present their rooms, prices, conditions and availability, and we provide the technology through which you make and manage Bookings. We do not own, operate, manage or control any Property, and we do not ourselves provide accommodation services.

When you complete a Booking, a contract for the provision of accommodation is created directly between you and the Property. Book Funduq is not a party to that contract. Our contractual relationship with you is limited to the booking services described in these Terms, for which we charge the Booking Deposit as our service fee.

Information about Properties (including descriptions, photographs, amenities and prices) is supplied and maintained by the Properties themselves through a self-service system. While we apply reasonable checks and require Properties to keep their information accurate and up to date, each Property remains responsible for the accuracy and completeness of its own listing.

4. Eligibility and accounts

You may only use the Platform if you are at least 18 years old and legally capable of entering into binding contracts. By making a Booking you warrant that you meet these requirements and that all information you provide is true, accurate and complete.

You can make a Booking with or without creating an account. If you create an account, you are responsible for keeping your login credentials confidential and for all activity carried out through your account. Notify us immediately at info@bookfunduq.com if you suspect unauthorised use of your account. We may suspend or close accounts used in breach of these Terms.

If you book on behalf of other guests, you confirm that you are authorised to do so, that they accept these Terms, and that you will inform them of all booking conditions. You remain responsible for the Booking, including its accuracy and any cancellation.

5. Making a booking and confirmation

The booking process is as follows: you select a Property, room type and dates; review the Total Price, Booking Deposit, Balance and the applicable cancellation conditions; provide guest details; accept these Terms; and pay the Booking Deposit online. Before payment you are always shown the exact amount charged online and the exact Balance payable at the Property.

Depending on the Property, your Booking is either confirmed instantly upon successful payment, or submitted as a booking request which the Property confirms, normally within 24 hours. If a booking request is declined or not confirmed in time, your Booking Deposit is refunded automatically and in full. The type of confirmation that applies is shown before you book.

Once confirmed, you receive a confirmation email containing your Confirmation Code, a QR document, the stay details, the amount paid online, the Balance payable at the Property and the applicable cancellation conditions. A confirmed Booking will not be cancelled unilaterally by the Property except in the limited circumstances described in our Cancellation & Refund Policy.

You are responsible for checking that the details of your Booking (dates, room type, number of guests, contact details) are correct, and for ensuring that you can receive email from us (including checking spam folders).

6. Prices, currency and taxes

All prices on the Platform are set by the Properties and are expressed and charged in US dollars (USD). Prices shown in other currencies are approximate conversions provided for convenience only, calculated using regularly updated exchange rates; the amount you pay online and the Balance you pay at the Property are always the USD amounts shown at checkout.

Unless expressly stated otherwise in the listing or at checkout, prices are per room for the selected dates and occupancy and include the services described in the listing. Any city taxes, tourist levies or additional services purchased at the Property are payable separately to the Property where indicated.

Guests are not charged any separate booking fee by Book Funduq: our service fee is the Booking Deposit, which is part of — not in addition to — the Total Price. Obvious errors in pricing (including manifestly incorrect prices resulting from technical failure) do not bind Book Funduq or the Property; in such cases we will contact you and offer to confirm at the correct price or cancel with a full refund of any amount paid.

7. Payment

At checkout you pay the Booking Deposit by card. Payment is processed by our payment service provider on secure, PCI-DSS-compliant infrastructure; your full card details are never transmitted to or stored on Book Funduq's servers. The Balance is paid by you directly to the Property in cash (USD) in accordance with the Property's instructions, normally at check-in or check-out.

Full details of amounts, timing, currency, security, refunds and failed payments are set out in our Payment Terms, which apply to every Booking.

8. Cancellation, changes and no-shows

Each Property sets its own free-cancellation window, which is displayed before you book, on your confirmation page and in your confirmation email. If you cancel before the Free-Cancellation Deadline, your Booking Deposit is refunded automatically, in full, to your original payment method. If you cancel after the deadline, or do not arrive (no-show), the Booking Deposit is not refunded; the Balance, which is only ever paid at the Property, is not charged.

Bookings cannot currently be modified directly; to change dates or rooms, cancel your existing Booking (subject to its cancellation conditions) and make a new one. If the Property cancels your confirmed Booking, or Book Funduq has to cancel it, your Booking Deposit is refunded in full. 9. Your stay at the property

At check-in the Property may ask for valid identification (passport or national ID) matching the lead guest name, together with your Confirmation Code or QR document. The Property may refuse guests who cannot provide these, in which case the Booking may be treated as a no-show.

During your stay you must comply with the Property's reasonable house rules (for example check-in and check-out times, smoking rules and quiet hours) as communicated in the listing or at the Property. You are responsible to the Property for any damage you or your fellow guests cause. Complaints about the accommodation itself should be raised first with the Property on site, where most issues are resolved fastest; our support team can assist where needed.

10. Acceptable use of the Platform

You agree to use the Platform only for making and managing genuine Bookings for yourself or people on whose behalf you are authorised to act. In particular, you must not:

• make speculative, false or fraudulent Bookings, or Bookings with stolen or unauthorised payment instruments;
• use robots, scrapers or other automated means to access, copy or monitor the Platform or its content without our prior written consent;
• circumvent, disable or interfere with security features or technical limitations of the Platform;
• resell, deep-link to for commercial purposes, or otherwise commercially exploit Platform content without authorisation;
• upload or transmit malicious code, or use the Platform in any way that breaches applicable law or the rights of others.

We may suspend or terminate access, cancel associated Bookings and, where appropriate, involve competent authorities in the event of misuse or fraud.

11. Platform content and intellectual property

The Platform, including its software, design, text, graphics, logos and trademarks (including Book Funduq), is owned by or licensed to Book Funduq and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Platform for personal, non-commercial purposes in accordance with these Terms. No other rights are granted.

The Platform may display content from third-party sources, such as maps and publicly available ratings. Such content is provided for general guidance; we do not guarantee its accuracy and it does not constitute a recommendation by Book Funduq. 12. Disclaimers and limitation of liability

We provide the Platform with reasonable skill and care. However, the accommodation services themselves are provided by the Property, and the Property is responsible for the performance of the accommodation contract, including the condition of the rooms and the accuracy of its listing. To the extent permitted by law, Book Funduq is not liable for the acts, errors, omissions, representations or negligence of any Property, nor for personal injury, death, property damage or other loss arising from your stay.

The Platform is provided on an as is and as available basis. We do not guarantee that it will be uninterrupted or error-free, though we work to keep it reliable and secure. To the extent permitted by law, our total aggregate liability to you arising out of or in connection with a Booking is limited to the amount of the Booking Deposit for that Booking, and our total liability arising out of your use of the Platform in any twelve-month period is limited to the total service fees (Booking Deposits) you paid to us in that period.

13. Indemnity

You agree to indemnify and hold Book Funduq harmless from claims, damages and reasonable costs (including legal fees) brought by third parties and arising out of your breach of these Terms, your misuse of the Platform, or your violation of applicable law or the rights of a third party, except to the extent caused by our own breach or negligence.

14. Suspension and termination

You may stop using the Platform, and may delete your account, at any time; account deletion is described in our Privacy Policy. Confirmed Bookings remain subject to their cancellation conditions.

We may suspend or terminate your access to the Platform, with immediate effect where justified, if you materially breach these Terms, misuse the Platform, or where we are required to do so by law. Where reasonably possible we will give you prior notice and an opportunity to respond. Termination does not affect accrued rights, and provisions which by their nature should survive (including liability limits and governing-law provisions) survive termination.

15. Changes to the Platform and these Terms

We continuously improve the Platform and may add, change or remove features. We may amend these Terms from time to time, for example to reflect changes in law, our services or business practices. The date of the latest version is shown at the top of this page. Material changes will be announced on the Platform or by email a reasonable time before they take effect. Changes do not apply retroactively: a Booking is governed by the version of these Terms in force when the Booking was made. If you continue to use the Platform after a change takes effect, you accept the amended Terms.

16. Governing law and disputes

These Terms and any dispute arising out of or in connection with them or the use of the Platform are governed by the laws of England and Wales, without prejudice to any mandatory consumer-protection rules of the country in which you habitually reside that grant you additional protection.

If you have a complaint, please contact us first at info@bookfunduq.com — we aim to resolve complaints quickly and fairly through our internal complaints procedure. If we cannot resolve a dispute amicably, the courts and consumer-dispute bodies competent under applicable law will have jurisdiction. As a consumer, you may also be entitled to bring proceedings before the consumer arbitration boards or courts of your place of residence where applicable law so provides.

17. General provisions

• Severability — if any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision is replaced by a valid one that most closely reflects its intent.
• No waiver — a failure by either party to enforce a right under these Terms is not a waiver of that right.
• Assignment — you may not transfer your rights or obligations under these Terms without our consent; we may assign this agreement to a successor of our business, provided your rights are not reduced.
• Language — these Terms are drafted in English and translated into other languages for convenience. In the event of any inconsistency, the English version prevails to the extent permitted by applicable law.
• Entire agreement — these Terms, together with the policies incorporated by reference and the booking-specific conditions shown at checkout, constitute the entire agreement between you and Book Funduq regarding the Platform.
